Can goods be seized during transit?

The immediate (mere) transit through Germany of goods which originate from abroad, and which are destined for a foreign country is normally not, under German legislation, seen as putting into circulation in Germany, and thus does not constitute an infringement of a German property right. The transit could no more than constitute a threat to an intellectual property right, and a seizure can therefore only be considered if the right-holder can demonstrate in the specific case that his intellectual property right has been infringed.
