Restrictions on the movement of services (technical assistance)
In addition to restrictions that relate to certain goods, that is, to the trading of goods, there are also restrictions on the provision of services.
In most cases these involve the provision of technology-related services, which are known as "technical support" or "technical assistance".
Technical assistance mainly comprises activities such as
- repair or maintenance,
- development or production,
- assembly or technical trials,
but also the provision of any other kind of technical support or services.
This also includes, for example, instruction or training, or the transmission (in a general sense) of technical knowledge and skills.
It is irrelevant whether the support is given orally, by telephone, electronically, or in writing.
Services may require an authorisation or be subject to a prohibition. This is particularly the case where certain countries, certain individuals, or types of goods that are under an embargo are concerned.
The competent authority in Germany is the Federal Office for Economic Affairs and Export Control.
You should be aware that in connection with the provision of specific services you may be obliged to notify the Federal Office for Economic Affairs and Export Control, which will then decide whether or not an authorisation is required.
