Overview of general conditions of employment

Employers have to grant all their employees working in Germany all working conditions specified in Section 2 of the Posted Workers Act. In detail, these are the regulations on:

  1. the remuneration, including overtime rates; without the regulations on the company pension scheme,
  2. minimum paid annual holiday,
  3. maximum work periods and minimum rest periods,
  4. conditions for the supply of labour, in particular by temporary employment agencies,
  5. health, safety, and hygiene in the workplace, including the conditions of workers’ accommodation where provided by the employer to workers away from their regular place of work;
  6. protective measures with regard to the terms and conditions of employment of pregnant women or women who have recently given birth, of children and of young people,
  7. gender equality and other non-discrimination provisions,
  8. allowances or reimbursement of expenditure to cover travel, board and lodging expenses for workers away from home for professional reasons.

Violations of compliance with general conditions of employment may be punished by the relevant authorities as an offence.
