Postings with a duration of more than 12 months

If you post a worker to Germany for longer than 12 months, you are obliged to comply with further regulations in addition to the terms and conditions of employment to be complied with for any employment. All working conditions regulated in legal and administrative provisions as well as in generally binding collective agreements then apply to you. The only exceptions are:

  • procedural and formal requirements and conditions concerning the conclusion or termination of employment, including post-contractual non-compete clauses, and
  • regulations concerning supplementary occupational pensions.

The additional regulations will apply as of the date from which the posting of the respective worker to Germany exceeds a duration of 12 months.
